TERMS OF SALE
Terms & conditions.
Terms applicable to Patxiki Painting services.
This translation is provided for information only. The French version is the legally authoritative version.
1. Purpose and scope
These terms and conditions govern miniature painting, lessons, coaching and related services offered by Patxiki Painting, a sole trader based in Bayonne.
2. Quotes and orders
Painting services are covered by a quote setting out, in particular, the nature of the project, the chosen finish level, the price and, where possible, an indicative timescale. A commission is considered confirmed once the quote has been accepted and the required deposit has been paid.
3. Prices and payment
Prices are stated in euros. VAT is not applicable under Article 293 B of the French General Tax Code. A 10% deposit is required to reserve and confirm the commission. The balance is payable under the terms stated on the quote or invoice. A payment schedule may be agreed where specified in the quote.
4. Performance of the service
The client supplies the miniatures in the condition agreed in the quote. Patxiki Painting does not provide an assembly service unless expressly agreed. Aesthetic choices, references and finish levels are agreed with the client before or, where required by the project, during the service.
5. Shipping and transport
A €5 flat fee applies to return shipping unless otherwise stated in the quote, in particular because of weight, destination or the level of insurance requested.
Patxiki Painting undertakes to take particular care when packing miniatures before shipment.
Transport risks are allocated in accordance with applicable law. In the event of loss or damage attributable to the carrier, Patxiki Painting will, where legally required, take the necessary steps with the carrier.
The miniature or miniatures are shipped after full payment of the invoice has been received.
6. Right of withdrawal
Where the right of withdrawal applies, consumers have the statutory 14-day period. For personalised services or services that begin at the client's express request before this period expires, the rules and exceptions provided by applicable law apply.
7. Complaints
Any issue relating to a service should be reported to Patxiki Painting as soon as possible so that an appropriate solution can be sought.
8. Consumer mediation
If a dispute remains unresolved after a prior written complaint, the consumer may use the CM2C consumer mediation service free of charge, in accordance with the current procedures and contact details provided by that mediator.
9. Personal data
Information supplied by the client is used to answer enquiries, prepare quotes and manage services. It is not sold or transferred to third parties for marketing purposes.
10. Applicable law
These terms are governed by French law. Mandatory statutory consumer protections remain fully applicable.
